INFORMATION WE COLLECT

We may collect three types of information about you: Personal, Financial, and Non Personal Information. Our player components may launch from anywhere and as such we can only provide our policy regarding our own data collection. We cannot provide information about the policies of the vast number of sites that may launch our components, that may or may not be a partner company.

"Personal Information." Personal Information refers to information that can identify you personally or otherwise reveal your own, personal characteristics or unique data, such as your name, e-mail, birth date and home address. Network Domain will use Personal Information only in the manner described in this Privacy Policy or as otherwise authorized by you. In all cases, we will protect your Personal Information from unauthorized disclosure in the same manner we would our own highly confidential information.

“Financial Information.” You may elect to use fee based services, enabling features such as turning off commercials. If you chose to use any fee-based services we will maintain a financial data recordand other billing information (e.g. your name, credit card number, billing address). If you choose to purchase one or more ecommerce items, you will be required to provide payment information, All such “Financial Information” is used only for billing purposes. Any disclosed Financial Information will be protected in an industry standard manner within laws regulating highly confidential data.

"Non Personal Information." Our goal is to provide you with the best commercials relating to your interests and needs while providing sponsors with better advertising expenditure efficiencies. To best serve viewers and sponsors we need to collect information. Non personal information refers to information that does not by itself identify you specifically by name or as a specific individual, rather we focus on account data for advertisement targeting dependent on your account profile. Examples of Non Personal Information may collect include, but are not limited to your provided keywords, age, gender, geographic region, which content types you most often view and how often you interact with sponsors and how often you make purchases while using any of the NDCTV Services.

We may collect Personal, Financial and Non Personal Information through any of the methods discussed below.

HOW WE COLLECT YOUR INFORMATION

Information.
You are not required to register or provided Personal or Financial Information to use Network Domain LLC Services or to view certain generally available content available on the NDCTV network. However, in order to have a better experience, you will need to register and create an NDCTV account with keywords. To engage in our TV Commerce (Tcommerce) you will be required to provide Personal and Financial Information ("Account Data"). We will retain your Financial Information in our database to facilitate your checkout process for future transactions.

As part of the Account Data or to participate in certain purchases or make use on non ad supported content offered by the NDCTV service, Network Domain LLC will ask you to provide certain information, which will personally identify you. For example, you may be asked to provide information concerning your preferences, current purchasing interests, and the like. Network Domain requests this information in order to enhance your TV experience by targeting advertising to your interests, this is needed to provide substantial benefit to you and sponsors alike.

Automatic Collection of Data.
While you are able to visit our while remaining anonymous, we may still collect certain other personally identifiable information about your use of the Service. For example, we may collect information concerning the type of Internet browser you are using, the type of computer operating system you are using, your IP address, your connection speed, the domain our player components were launched from, your Internet service provider, the geographic location from which you are accessing the Service and links which directed you to load our video player components. Once you have registered with us, we also track and collect information about you, including your transactions with us, our partners, or other links, and your site usage patterns, such as the pages on the website you have visited, searches you have conducted and the amount of time you have spent using our player components and services. If you contact us, we may keep a record of your correspondence.

Cookies.
When you visit any site that loads our player components, click through hyperlinks appearing thereon, or use any of our services, we may use an industry-wide technology called "cookies" which stores certain data on your computer and which will allow us to customize your experience to better match your interests and preferences or simply facilitate signing-in to use the network of providers. Most browsers will allow you to erase cookies from your computer hard drive, block acceptance of cookies, or receive a warning before a cookie is stored. Please refer to your browser instructions or help screen to learn more about these functions. Please note, however, that if you set your browser to block acceptance of cookies, you will not be able to use our services and will not be able to access to your account.

Client Desktop Applications and Set-Top-Box software
You may download our desktop version application or it maybe embedded into your Set-Top-Box. In order to keep such software working properly and to add functionality, we may periodically install updates, fixes or support files to the player components. Once it has been downloaded to your computer or Set-Top-Box, the NDCTV application may keep track of events such as advertising, your viewing of content, and transmit such information to us for use as an example to account for advertising events.

WHAT WE DO WITH YOUR INFORMATION

We may use Personal and Non Personal Information to improve and enhance the Service. We may also share Non Personal Information and other non personally identifiable information collect with automatic means with partners including, but not limited to, third party service providers. We do not share your Financial Information with any affiliate or any other third party, except for order processing and credit card clearance as described below.

If you provide us with Personal or Financial Information, we will take reasonable and appropriate steps to protect this information in accordance with this Privacy Policy. Except as otherwise provided herein, we will not disclose, share, sell or rent Personal or Financial Information collected through the Service to any third party without your prior consent. Notwithstanding the foregoing, we reserve the right to disclose any information to any third party when we believe, in our sole discretion, that: (i) the law requires it or a law enforcement agency has requested it; (ii) it is necessary to enforce our Terms and Conditions; or (iii) it is required to protect the rights, property, safety, or security of Network Domain LLC , the NDCTV network, our content providers or the public.

We work with third parties who provide our services to the public and other services. Example third parties may include website hosting, promotion fulfillment, order processing, credit card clearance, data analysis and other services of an administrative nature. Personal Information may be shared with such third parties only when necessary to provide such Service to you. Financial Information will only be shared with third parties as necessary for order processing and credit card clearances. We seek to impose confidentiality obligations on such third parties. In addition, entities into which our company is merged, or to which our assets, site or operations have been transferred or sold, will be able to use your Personal, Financial and Non Personal Information under the terms of this Privacy Policy.

HOW TO REVIEW, UPDATE OR DELETE YOUR ACCOUNT INFORMATION

As part of your use of our Service, you are responsible for updating and ensuring submitted information is current and complete. In order to update information, please access your Account Data and make the desired changes. You may also access your Account Data in order to change your preferences such as unsubscribing to our mailing list. Please note that by using our Service, you signify your agreement to this Privacy Policy. THIRD PARTY ADVERTISERS; LINKS TO OTHER

Third Party Advertisers.
We may allow other third party entities to serve advertisements on the Service. These third parties may use technology to send, directly to your video player, browser, advertisements and links. They may automatically receive your IP address when this happens. They may also use technologies to measure the effectiveness of advertising campaigns.

We do not provide any Personal or Financial Information to these third parties. However, please note that advertisers want to target advertisements to a certain audience or audience segment we may disclose Non Personal Information as well other non-personally identifiable information to facilitate analytics. In addition, when you respond to an advertisement, the advertiser may conclude that you fit the description of the audience they are trying to reach. 

Linking.
Linking to other is an integral part of the functionality of the Internet, including our Service. Any link to a page which moves you outside of our supplemental content component maybe a link to a site outside of our Service and thus outside our control. This includes links to our content suppliers, affiliates, and links to any advertisers or third parties that may be linked to our Service. These other sites may send their own cookies to you, collect data or otherwise solicit information. Network Domain LLC cannot guarantee and is not responsible for the content of any third party. While Network Domain strives to protect our visitors' Personal Information and privacy, we cannot guarantee the security and privacy of any information you disclose at other sites so you do so at your own risk.

SECURITY

Network Domain protects your Personal and Financial Information using state-of the-art technologies and a secure physical environment. The Service is monitored 24x7 to ensure they are not accessed or used by unauthorized parties.

Secure Socket Layer (“SSL”) encrypted communication is used to protect all Financial Information. SSL is a standard format for transmitting secure date from your computer to Network Domain servers. Additionally, to protect your personal information, Network Domain uses encryption and restricts employee access to databases containing Personal Information, imposes confidentiality requirements upon employees who do have access to databases containing Personal and Financial Information, and binds subcontractors with contractual, technical and organizational measures to further protect this information.

To help protect your Personal and Financial information, please keep your password secure. We suggest you pick a non-obvious password mixing numbers and letters. In addition, do not divulge your password to anyone. Ultimately, you are responsible for maintaining the secrecy of your passwords and any Account information. Remember to sign out of your Account and close your browser window whenever you leave your computer, Set-Top-Box or smart phone. Network Domain's Privacy Policy does not extend to anything that is inherent in the operation of the Internet, and therefore beyond Network Domain's control, and is not to be applied in any manner contrary to applicable law or governmental regulation.

SPECIAL NOTE REGARDING CHILDREN UNDER 13 YEARS OF AGE

Network Domain respects the privacy of children. Network Domain particularly recognizes the sensitivity of Personal Information concerning children under the age of 13 and therefore requires parent(s) or guardian(s) to setup a master account and assign constraints to the subaccount used by anyone under 13 years of age and under 18 years of age as parent(s) or guardian(s) deem necessary. The Master Account is provided thereon is intended for access and use strictly by adults over 18 years of age and persons ages under 18 with the consent of their parent or guardian. As such, it is not Network Domain's intention to collect nor maintain any personally identifiable information from children under 13 years of age. Although Network Domain does not seek to collect any personal information from children under the age of 13, should you find that your child has submitted his/her information, Network Domain will make reasonable efforts to delete a child's information from its database upon request. You may request to have such information purged from Network Domain's database by sending an email request to customercare@Network Domain.com. In the event that you are requesting such information to be purged from Network Domain's database, please make sure to include the correct email address that was submitted by the child.

NON-US CUSTOMER INFORMATION

If you are a customer who is logging on from outside the United States, the personal information you submit to Network Domain may be sent to and stored in servers in Network Domain’s U.S. datacenters. The personal information practices set out in this Policy apply to all Network Domain' customers worldwide.

E-MAIL COMMUNICATIONS

In order to keep you informed about our Service, we may send you e-mails and announcements that are needed for the administration of our Service. We also may give our users the option of joining mailing lists to receive additional information about our Service, updates and special promotions and offers. In addition, we allow you to choose whether you would like to receive mailings from third party content providers and advertisers. You can always change your options by accessing your Account Data through the Service. You may opt-out of certain communications, such as these, by following the instructions included in each communication (e.g. following the unsubscribe instructions within the e-mail).

CHANGES TO OUR POLICY

Network Domain continually strives to implement new technologies and processes to better protect you, your privacy and your use of the Service. As a result, changes to this Privacy Policy may be made by Network Domain from time to time. In no event will these changes result in the degradation of any of the security measures designed to protect you from unauthorized disclosure, as such measures are described in this Privacy Policy. To the extent Network Domain changes any policies related to its use of Personal or Financial Information, Network Domain will provide you with at least thirty (30) days prior notice via e-mail. You will be provided with an opportunity to “opt out” of these changes, but such choice may affect your ability to use all or part of the Service.

NO ERROR FREE PERFORMANCE

Network Domain may release alpha and beta versions of the Service, which are further refined before the release of the final version. Because these products are still in a test phase, Network Domain may not always catch an unintended privacy issue, despite our efforts to do so. As such, Network Domain welcomes feedback on any privacy concerns you may have, and on how to improve our products generally, in all stages of release. Network Domain does not guarantee error-free performance under this Privacy Policy at any stage of release. Network Domain will use reasonable efforts to comply with this Privacy Policy and will take prompt corrective action upon learning of any failure to comply with this Privacy Policy. Network Domain shall not be liable for any incidental, consequential or punitive damages relating to this Privacy Policy.
